
ArmInfo. Armenia plans to introduce mechanisms for the electronic transfer of information containing banking secrecy. The National Assembly of the Republic of Armenia will discuss amendments to the Criminal Procedure Code and a package of related laws in the first reading at its plenary session on March 25.
As Deputy Minister of Justice of the Republic of Armenia Gevorg Kocharyan noted in his speech, the seizure of documents including medical, notarial, bank or related secrecy and objects is carried out exclusively on the basis of a court decision. In recent years, the number of decisions to obtain information containing bank secrecy has sharply increased, due to which the time and resources spent on processing, preparing, as well as on transferring the information have also increased. It has complicated the work of the law enforcement system and financial institutions, also leading to the extension of the necessary deadlines for providing the required information.
The draft law proposes that in the event of the seizure of information containing bank and related secrecy, the law shall also provide for an electronic method of seizure. The implementation of the aforementioned process electronically is aimed at reducing the time and resources spent on transferring information, as well as at reducing human involvement in the process of transferring confidential information. Obtaining the relevant data electronically does not imply that information constituting bank or related secrecy may be transferred via any electronic means, including official or work email.
According to the Deputy Minister, in the event of the adoption of new regulations, a specially protected electronic system should be introduced through which seizures should be carried out.
